1. INTRODUCTION

1.1 Welcome to the FlyCloud platform (the “Platform”). Please read the following Terms of Service carefully before using the Platform or registering for a FlyCloud account (the “Account”). The “Services” we provide or make available include: (a) the Platform; (b) services provided by the Platform and FlyCloud client software made available through the Platform; and (c) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, videos (including live streams), messages, tags, content, programs, software, application services (including without limitation mobile application services), or other materials made available through the Platform or related services (collectively, the “Content”). Any new features added to or augmenting the Services shall also be subject to these Terms of Service. These Terms of Service govern your use of the Services provided by FlyCloud.

1.2 The Services include an online platform service that provides a venue and opportunity for the sale of goods between buyers (“Buyers”) and sellers (“Sellers”; collectively, “you”, “Users” or “the Parties”). The actual sales contract is formed directly between Buyers and Sellers. FlyCloud is not a party to such contract or any other contract between Buyers and Sellers, and assumes no obligations in connection with any such contract. The Parties to a transaction shall be solely responsible for the sales contract between them, product listings, purchase warranties, and related matters. FlyCloud does not participate in transactions between Users. FlyCloud may pre-screen Users or the Content and information provided by Users, and reserves the right to remove any Content or information you post on the Platform pursuant to Section 6.4 of these Terms.

1.3 Before becoming a User of the Platform, you must read and accept all terms and conditions contained in and linked to these Terms of Service, and you must consent to the processing of your personal data as described in the Privacy Policy attached hereto.

1.4 FlyCloud reserves the right to change, modify, suspend or discontinue all or any part of the Platform or the Services at any time or upon notice as required by local laws. FlyCloud may release certain Services or features in a beta version, which may not operate properly or in the same manner as the final version, and FlyCloud shall not be liable therefor. FlyCloud also reserves the right, in its sole discretion, to impose limits on certain features or restrict your access to part or all of the Platform or the Services, without prior notice or liability.

1.5 FlyCloud reserves the right to refuse to provide you with access to the Platform or the Services, or to refuse your Account registration, for any reason whatsoever.
