1.1 Welcome to the Global FlyCloud platform (hereinafter referred to as the "Platform"). Before you use the Global FlyCloud platform, register a Global FlyCloud account (hereinafter referred to as the "Account"), or open a Global FlyCloud store (hereinafter referred to as the "Store"), please carefully read these Terms of Service to clarify the legal rights and obligations between you and Global FlyCloud (individually and collectively referred to as "Global FlyCloud", "we", "us" or "our"). The services provided by us (hereinafter referred to as the "Services") include: (1) the Platform (including mobile applications); (2) services provided by the Platform and Global FlyCloud client software; (3) all information, webpages, functions, data, texts, pictures, photos, graphics, music, audio, videos, materials, tags, content, programs, software and application services associated with or relying on the Platform (including but not limited to various mobile application services) (collectively referred to as the "Content"). Any new or upgraded functions of the Services shall be subject to these Terms of Service. These Terms of Service govern your use of the services provided by Global FlyCloud.

1.2 Global FlyCloud Rules: Various terms and conditions applicable to sellers published and updated from time to time on the Platform, including but not limited to Cross-border Seller Terms of Service, Privacy Policy, Prohibited and Restricted Commodity Rules, Global FlyCloud Logistics Service Terms, Seller Center rules and the aforesaid policies and terms, as well as new rules and terms to be issued in the future. Unless otherwise stipulated in these Terms of Service, the definitions of terms in the Global FlyCloud Rules shall apply to these Terms of Service.

1.3 Global FlyCloud Platform: The websites and mobile shopping applications provided and operated by Global FlyCloud, including but not limited to the Global FlyCloud cross-border shopping website and mobile client.

1.4 By using the Services, registering an account or opening a store on the Platform, you irrevocably accept and agree to these Terms of Service, as well as the additional terms and rules mentioned herein or specified by hyperlinks. You shall also comply with the terms of service of the site in the country/region where your store is located. Acceptance of these Terms of Service shall not exempt you from the obligation to read and abide by the terms of service of the local site. In case of any conflict between these Terms of Service and the terms of service of your local store site, the latter shall prevail.If you have signed a separate written agreement with us for specific services, such separate written agreement shall prevail in the event of any inconsistency with these Terms of Service.

1.5 The Services are online platform services that provide sellers ("you", "users", "sellers") with transaction venues and opportunities. The sales contract is concluded solely between buyers and sellers. Global FlyCloud is not a party to any sales or other contracts between buyers and sellers and shall assume no liability therefor. Buyers and sellers shall bear full responsibilities for transaction contracts, product listings, after-sales guarantees and other related matters. Global FlyCloud does not participate in transactions between users. We reserve the right to pre-review users or content/information submitted by users, and to delete any content or information you upload on the Platform in accordance with Clause 6.5. Global FlyCloud does not guarantee that users will complete transactions successfully.

1.6 Before becoming a user of the Services, you must read and accept all contents contained in and linked to these Terms of Service, and agree to the provisions on the processing of personal data of buyers and sellers set forth in the Privacy Policy (if any).

1.7 Once you become a user of the Services, if you violate these Terms of Service and other applicable rules and policies (including but not limited to additional terms referenced herein or in the Global FlyCloud Rules), Global FlyCloud has the right to take disciplinary measures in accordance with these Terms of Service and relevant rules (including but not limited to the sanctions specified in Clause 7.1 herein). You undertake to unconditionally accept the disposal by Global FlyCloud and bear corresponding legal liabilities.

2.1 Global FlyCloud attaches great importance to privacy protection. The Privacy Policy specifies in detail our privacy protection practices. Please read the Privacy Policy carefully to understand how we collect and use your account information and personal information related to your use of the Services. By using the Services and submitting information on the Platform, you consent to Global FlyCloud collecting, using, disclosing and processing the content and personal information (if any) generated during your use of the Services in accordance with this Agreement and the Privacy Policy.

2.2 Users who use the Services and hold third-party personal data (hereinafter referred to as the "Recipient") undertake to: (1) comply with all laws and regulations concerning personal information protection; (2) allow the information disclosing party to delete its information from the Recipient’s database; (3) allow the information disclosing party to view the personal information collected about it by the Recipient. In the event of circumstances set forth in (2) and (3) above, you shall act in strict compliance with applicable laws and regulations.

3.1 Global FlyCloud grants you a limited and revocable right to log in to and use the Services in accordance with these Terms of Service. All proprietary content, trademarks, service marks, brand names, logos and other intellectual property rights displayed on the Platform belong to Global FlyCloud and identified third-party right holders (if applicable). We do not grant or implicitly permit any party to use or replace such assets, and you shall not claim any ownership or rights thereto. By using the Services, you agree to abide by copyright laws, trademark laws and other applicable laws protecting the Services, the Platform and the Content. You shall not copy, distribute, transmit, publicly display, publicly perform, modify, adapt, rent or sell any part of the Services, the Platform or the Content, nor create derivative works based thereon. Without our prior written consent, you shall not mirror or frame all or part of the Platform on other servers or embed it into any other website or platform. In addition, without our prior written permission, you shall not use robots, crawlers, automated tools or manual processes to monitor or copy our Content (excluding conventional retrieval guided by standard search engines).

3.2 You may link to the Platform from your own website or platform, provided that your website/platform shall not imply endorsement by Global FlyCloud or any affiliation with Global FlyCloud. You acknowledge that we may suspend part or all of the Services at any time in compliance with laws, regulations and the principle of good faith.
